Legal notice
1. Purpose of This Legal Notice
This Legal Notice sets out important legal information about The Cork Plug (referred to in this document as "The Cork Plug," "we," "us," or "our"), about the website at www.thecorkplug.com (the "Site"), and about the products we sell. It is intended to be read together with our Terms of Service, our Privacy Policy, our Return and Refund Policy, and our Shipping Policy.
By using the Site, browsing our products, or placing an order with us, you confirm that you have read and understood this Legal Notice. If there is anything here you do not understand or do not agree with, please contact us before using the Site or placing an order.
We have written this notice to be thorough and to leave as little room for misunderstanding as possible, particularly in relation to who we are, our relationship (or lack of relationship) with the original brands, and the condition of the items we sell. Please take the time to read it in full.
2. Who Operates This Site
This Site is operated by The Cork Plug, an independent online retailer of clothing, footwear, and related goods. We sell to customers worldwide, with the Republic of Ireland as our primary market.
You can reach us at any time using the contact details below, and we will respond as promptly as we reasonably can:
The Cork Plug Website: www.thecorkplug.com Email: info@thecorkplug.com
Where we are required by the law that applies to us to publish further identifying information, such as a registered company name, registered business address, company registration number, or VAT registration number, that information will be provided in the relevant section of the Site and may be requested from us using the contact details above.
3. Independent Reseller Status and Non-Affiliation With Brands
The Cork Plug is an independent reseller. We are not affiliated with, associated with, authorised by, endorsed by, sponsored by, approved by, or in any other way officially connected to any of the original brands, manufacturers, designers, fashion houses, or other rights holders whose products may be offered, described, or referenced on the Site.
We want this to be completely clear, so we say it in more than one way:
- We do not claim to be an official store, authorised retailer, authorised dealer, official stockist, distributor, agent, licensee, or representative of any brand.
- We have no partnership, sponsorship, agency, joint venture, or other commercial relationship with any of the original brands whose goods we may resell.
- Any reference we make to a brand, a product line, a model name, or a style, where such a reference is made at all, is made solely for the honest and practical purpose of identifying and describing an item so that you, the customer, understand what you are buying.
- The use of any brand name or descriptive reference does not imply, and should not be taken to imply, any endorsement of The Cork Plug by that brand, or any approval, sponsorship, or affiliation of any kind.
If you are seeking goods together with the official warranties, guarantees, authentication services, after-sales support, repairs, or other services that an original manufacturer or its authorised retail network might provide, please understand that, because we are an independent reseller and are not affiliated with those brands, those manufacturer-provided services may not be available for items purchased from us. The rights and remedies that apply to items you buy from us are those set out in our Terms of Service, our Return and Refund Policy, and the consumer protection law that applies to you, as described in Section 7 of this notice.
4. Trademarks and Intellectual Property of Third Parties
All brand names, trademarks, registered trademarks, trade names, logos, service marks, design rights, and other intellectual property that may appear on the Site are, and remain, the exclusive property of their respective owners. They are protected by the intellectual property laws that apply to them.
The appearance of any third-party name, mark, or logo on the Site, in a product listing, in marketing material, in customer communications, or anywhere else does not transfer any rights to us or to you, and does not create any association, affiliation, sponsorship, or endorsement between The Cork Plug and the owner of that name, mark, or logo.
We respect the intellectual property rights of others, and we expect users of the Site to do the same. If you believe that any content on the Site infringes your intellectual property rights, please contact us at info@thecorkplug.com with details, and we will review the matter and respond appropriately.
Nothing in this notice should be read as a claim by The Cork Plug to own, or to have the right to use, any third-party trademark or other intellectual property beyond the limited, descriptive references necessary to identify and sell the goods we offer.
5. Our Own Intellectual Property
The parts of the Site that we create and own, including our written content, our original product descriptions, our photographs where we take them, our page layouts, and the overall look and feel of the Site, are the property of The Cork Plug or are licensed to us. They are protected by applicable intellectual property laws.
You may view and use this content for your own personal, non-commercial use in connection with shopping with us. You may not copy, reproduce, republish, distribute, modify, or commercially exploit our content without our prior written permission. This is separate from, and does not affect, the rights of third parties in their own brand names and intellectual property, as described in Section 4.
6. Condition of Goods: New, Pre-Owned, Refurbished, and Renewed Items
We sell a range of goods, and the condition of those goods varies. Some items we sell are brand new. Other items we sell may be pre-owned, refurbished, renewed, restored, or otherwise reconditioned in order to give them a better and longer usable life. We believe in being open about this, and we want you to know what to expect before you buy.
What "refurbished" and "renewed" mean here. When we describe an item as refurbished, renewed, restored, or reconditioned, we mean that the item is not brand new, and that it has been inspected, cleaned, repaired, treated, or otherwise prepared so that it is in good and usable condition. Our aim with refurbished and renewed goods is to extend their useful life and to offer them at a fair price, rather than to present them as factory-new.
What you can expect from a refurbished or renewed item. Items that are refurbished or renewed may carry minor signs of previous use, handling, age, or storage. This can include small marks, light wear, minor cosmetic blemishes, or other characteristics consistent with an item that is not brand new. These are a normal part of a refurbished or renewed item and are not regarded as faults or defects.
Packaging and accessories. Because refurbished and renewed items come to us from the resale market and vary from piece to piece, the packaging, boxes, dust bags, tags, labels, or accessories that might accompany a brand new equivalent may not be included. Where original packaging or accessories are included, or where they are not, we will try to make this clear in the listing.
Disclosure in listings. Where an item is not sold as brand new, we aim to indicate its condition in the relevant product listing so that you can make an informed decision. If you are ever unsure about the condition of a specific item before buying, please contact us and we will do our best to give you the information you need.
Your rights are not reduced. Nothing in this section removes, reduces, or limits your legal rights as a consumer. If an item arrives faulty, materially not as described, or otherwise not in the condition we represented at the time of sale, you are entitled to the remedies available under our Return and Refund Policy and under the consumer protection law that applies to you. The purpose of this section is simply to make sure that, before you buy, you understand that some of our goods are intentionally and openly sold as refurbished or renewed rather than as new.
7. Consumer Protection and Your Statutory Rights
If you are a consumer, you benefit from legal protections that cannot be excluded or limited by us. These may include the right to receive goods that match their description, that are of satisfactory quality, and that are fit for their intended purpose, together with the right to certain remedies if those standards are not met.
For customers in the Republic of Ireland and the European Union, these protections include the rights given by Irish and EU consumer protection law. For customers elsewhere, the mandatory consumer protection law of your country of residence may also apply. Where any statement in this notice or in our other policies conflicts with the mandatory consumer protection law that applies to you, that law takes precedence to the extent of the conflict.
Nothing in this Legal Notice is intended to affect those statutory rights.
8. Accuracy of Information on the Site
We take care to make the information on the Site as accurate and up to date as we reasonably can, including product descriptions, images, prices, and availability. Even so, the Site may from time to time contain errors, inaccuracies, or omissions, and information may become out of date.
We reserve the right to correct any errors, to update information, and to change content on the Site at any time without prior notice. Where an error affects an order you have placed, we will handle it in accordance with our Terms of Service. Images are provided for illustration, and small differences between the image shown and the item received, particularly in the case of refurbished or renewed goods, are normal.
9. Pricing, Taxes, Duties, and International Orders
Prices are shown in the currency stated at the point of sale and may change at any time, although changes will not affect orders we have already accepted. Depending on your location and delivery destination, prices may or may not include applicable taxes such as VAT.
For international orders, your shipment may attract import duties, customs charges, handling or brokerage fees, and local taxes imposed by the destination country. These charges are outside our control and, unless we expressly state otherwise, are your responsibility as the customer and importer of record. We recommend checking with your local customs authority before ordering if you would like to understand the charges that may apply.
Full details of how pricing, payment, taxes, and duties are handled are set out in our Terms of Service.
10. Limitation of Liability and Disclaimers
The Site and its content are provided on an "as is" and "as available" basis. While we work to keep the Site accurate, secure, and available, we do not guarantee that it will be uninterrupted, error-free, or free from harmful components, and your use of the Site is at your own risk in this respect.
To the fullest extent permitted by the law that applies to you, and except for the statutory rights and protections described in Section 7 that cannot lawfully be excluded, our liability in connection with the Site and the goods we sell is limited as set out in our Terms of Service. Nothing in this notice or in our Terms of Service excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence or for fraud.
11. Privacy and Data Protection
We handle your personal data in accordance with our Privacy Policy and with applicable data protection law, including the General Data Protection Regulation (GDPR) as it applies in Ireland and the European Union where relevant. Our Privacy Policy explains what personal data we collect, why we collect it, how we use and protect it, how long we keep it, and the rights you have in relation to it. Please read our Privacy Policy for full details.
12. Third-Party Links and Services
The Site may include links to third-party websites and may rely on third-party providers for services such as payment processing, hosting, and delivery. We do not control these third parties and are not responsible for their content, products, or practices. Any use of a third-party website or service is at your own risk and is subject to that third party's own terms and policies. A link to, or use of, a third party does not imply our endorsement of that third party.
13. Changes to This Legal Notice
We may update this Legal Notice from time to time to reflect changes in our business, our practices, or the law. When we do, we will post the updated version on the Site and update the "Last updated" date shown above. Changes take effect when posted. We encourage you to review this notice periodically so that you remain aware of its current contents.
14. Governing Law
This Legal Notice, and any dispute or matter arising from it, is governed by and interpreted in accordance with the laws of the Republic of Ireland, without affecting any mandatory protections available to you under the law of your country of residence if you are a consumer based outside Ireland.
15. How to Contact Us
